What Is a Certificate of Lawfulness?

A Certificate of Lawfulness is a legal document issued by the local planning authority confirming that a use or development is lawful for planning purposes. It provides certainty and protects landlords and owners from future planning enforcement.

There are two types:

  • Existing Use or Development (CLEUD) – confirms something already in place is lawful

  • Proposed Use or Development (CLOPUD) – confirms a proposal would be lawful before works begin


Why Is It So Important?

A Certificate of Lawfulness has become increasingly important, particularly for landlords and investors. Many local councils now require confirmation of lawful use as part of an HMO licence application, especially where the planning history is unclear.

It is also a key document for buyers and solicitors during a property sale, often requested to confirm that a property’s use is lawful before contracts are exchanged. Without it, transactions can be delayed, renegotiated, or even fall through.

Once granted, the certificate is legally binding and runs with the land.
